OPEN LETTER TO ALL ORGANISATIONS AND PEOPLE WHO ADVOCATE THE PRESERVATION OF NATURE AND/OR DEMOCRATIC RIGHTS
Have you heard of the incidents that occurred in Ecuador during the last three weeks? The government is violating the democratic constitutional rights in a most severe dimension.
Let me summarize: The socialist president Rafael Correa is in office since 2006 and has always been incredibly popular among the general public. 2008 he drafted a new constitution which has been approved by a vast majority of the people. Therein the rights of the indigenous peoples as well as the integrity of nature are embedded on the highest legislative level. Last year Correa was reelected and he will stay in office until 2017, if he stands by his promise and resigns then.
Through the public notification of the Yasuní-ITT Initiative, which aimed at keeping underground the large amounts of oil reserves situated beneath parts of the Yasuní National Park, through financial support provided by the international community, Correa gained international attention. The Yasuní National Park lies in the far east of the country and is part of the Amazon region. Although the initiative has been met by acclamation, the support itself ceased to follow, be it due to the lack of trust or the lack of a sense of responsibility by most of our governments.
A few months ago the initiative was revoked and it became known that preparations had already been made for oil exploitation in the Yasuní lowland rainforest.
Outrage in the civil society was huge; they had to recognize that their president had first adopted, but then abandoned their innovative idea, blaming the international community for having failed Ecuador. Thus it was decided to collect signatures in order to let a referendum determine the fate of the Yasuní. According to the chapter “Direct Democracy” in the constitution at least 5% of the registered voters’ signatures must be handed in to enforce a nationwide referendum.
Initially being denounced by president Correa himself as a “lazy crowd” unable to achieve the requirements, the Ecuadorian civil society, led by the newly founded collective “YASUNIDOS” (“United for the Yasuní”), managed to obtain 756.000 signatures. This amount exceeds by far the required quorum of approximately 580.000 valid signatures.
What happened since indeed is a mockery of the constitutional right of democratic co-determination. More than 700.000 Ecuadorians are subject to the violation of their rights, which are guaranteed by the constitution:
- The surveillance of the supposedly impartial verification of the collected signatures (by the National Electoral Commission CNE and the YASUNIDOS) is biased and partial. The sealed signature boxes were opened without the presence nor consent of YASUNIDOS. On top of that various ID copies of the signature collectors, which are needed for the verification, have “disappeared”. Just through one missing ID copy up to thousands of signatures potentially become invalid.
- A vast amount of signatures has been confiscated from the CNE building with the use of military and police force, disregarding the agreed upon procedure.
- According to YASUNIDOS, they have been stalled for several days, harassed and mocked by the CNE employees. After some days they were fed up with the unjust treatment and decided to withdraw from the “independent verification” in protest.
- A large amount of signatures has been declared invalid for bureaucratic reasons (such as: handwritten ID numbers exceeding the box space, illegitimate paper thickness, illegitimate paper format, illegitimate paper colour, stains on the signature sheets, illegitimate character font and so on).
- Despite all these accusations throughout the supposedly democratic proceedings, president Rafael Correa never commented on it or took measures of amelioration.
For all these reasons, YASUNIDOS are now calling on the international community – that means us – to help achieve an independent validation of the submitted signatures, under national and international supervision.
This is what’s at stake:
- A setback of Ecuador into times of chaos, kleptocratic governments and coups d’etats. The continuation of a still very young, but hopeful democracy in a South-american country needs to be protected, guaranteeing the rightfulness of the processes inherent to a democratic state system.
- The exploitation, contamination and subsequent colonization of Yasuní, he highly biodiverse Amazon national park that has a population density of many animal species second to none (e.g. the Jaguar). The Yasuní area is still inhabited by at least two ‘undiscovered’ and uncontacted tribes (Tagaeri, Taromenane), that consciously are rejecting ‘civilization’ and have been subject to encirclement and constriction for years.
- In general: The defence of all yet existing primary forests and lowland rainforests in the world, by virtue of democratic majority demands. If this does not happen now in Ecuador now – where the consultation of the population through a national referendum is guaranteed by the constitution – in what other country could this breakthrough happen in the near future?! As earth citizens in solidarity with Ecuadorian civil society and all legitimate dwellers of the Amazon, let us all scream out our disagreement! Let us scream out, too, as voices of all those who are not heard at all: The generations of the future and the autonomous peoples of the Earth!
The future of Amazonian rain forests, refuges of unimaginable biological and cultural richness, stabilizers of global climate dynamics and our greatest producers of oxygene, ultimately is on the brink. Yasuní is a symbol of a much greater picture: The people of this earth are fed up with having to witness the destruction of life. Ecuadorians speak for all of us when they say “Now it is enough! Until here and not one step further!”
We want to BRING TO WORLDWIDE ATTENTION NOW the drama of Yasuní – probably the most fantastic national park on earth – in order to show that we will not tolerate anymore the predatory exploitation of nature in the name of greed to oil, minerals and megaplantations.
In the wake of this globally important emergency of democracy and environment, please do – as organisation or private person that has vowed to defend human rights and nature – stand up for these rights in Ecuador. Become actively involved, be it through the publication of the problem among the members of your organization and among your friends, colleagues and social, or be it by contacting Ecuadorian government and its political representations worldwide. If you have the recourses, try to take part in the supervision of the democratic process of repeated signature counting and, if applicable, the implementation of the constitutional referendum in Ecuador.
Similar projects of exhaustive exploitation are currently endangering the rainforests of Peru (e.g. the huge MANU reserve). The vast dimensions of destruction in Brazil and Indonesia are sufficiently well-known. What now unique and different in the actual case of Yasuní Ecuador, is, that the global community is being offered a big window of opportunity and publicity to demonstrate its cohesion for the conservation of the world’s most important ecosystems.
International organisations, NGOs and governments of all parts of the world can show their ability to cooperation. As Ecuadorian civil society has shown through their signatures, we can as well give a sign that THE MAJORITY OF THE PEOPLE IN THE WORLD HAS SEEN ENOUGH AND OBJECTS. There is no need to collect money, but we all have to raise our voice now to safeguard democracy and rightfulness, ultimately contributing to the survival of Mother Earth’s lungs – our tropical rainforests.
We will use our freedom of expression, and we will not back down until global advocacy for the protection of the rainforests, their rightful dwellers and their natural and spiritual treasures is established. The dignity and rectification of our modern western society is at stake.

OFFENER BRIEF AN ALLE ORGANISATIONEN UND MENSCHEN, DIE SICH FÜR DIE ERHALTUNG DER NATUR UND/ODER FÜR DEMOKRATISCHE RECHTE EINSETZEN
Haben Sie schon die Vorkommnisse während der letzten drei Wochen in Ecuador vernommen?
Zurzeit findet dort eine Verletzung der demokratischen Verfassungsrechte in hunderttausendfacher Ausführung statt, seitens der Regierung!
Lassen Sie mich kurz ausführen: Der sozialistische Präsident Rafael Correa ist seit 2006 im Amt und in der breiten Bevölkerung immer unglaublich populär gewesen. 2008 hat er eine neue Verfassung entworfen, welche vom Volk mit grosser Mehrheit angenommen wurde. Darin wurden die Rechte der indigenen Bevölkerungsgruppen sowie die Integrität der Natur auf oberster Gesetzesstufe verankert. Letztes Jahr wurde Correa wiedergewählt und bleibt noch bis 2017 im Amt, falls er sein Versprechen einhält und dann zurücktritt.
Internationale Bekanntheit erreichte er mit der Bekanntmachung der Yasuní-ITT Initiative, welche bei internationaler finanzieller Unterstützung die grossen Ölvorkommen unter Teilen des Yasuní-Nationalparks im Erdboden gelassen hätte. Der Yasuní-Nationalpark befindet sich ganz im Osten des Landes und ist Teil des Amazonasgebietes. Der Beifall für die Initiative war zwar von allen Seiten gross, doch die Unterstützung blieb aus, wohl aus mangelndem Vertrauen, und weil sich die meisten unserer Regierungen nicht verantwortlich fühlten.
Nun wurde vor ein paar Monaten die Initiative abgeblasen und es wurde bekannt, dass man bereits mit den Vorbereitungen zur Ölförderung im Yasuní-Tieflandregenwald begonnen hatte.
Der Aufschrei in der Zivilgesellschaft war gross; der Präsident hatte die Idee nämlich von ihr übernommen und dann öffentlich zu Grabe getragen. Man entschied also, durch eine Unterschriftensammlung das Schicksal des Yasuní über eine Volksabstimmung entscheiden zu lassen. Laut dem Kapitel „Direkte Demokratie“ in der Verfassung sind für die Erzwingung einer Volksabstimmung die Unterschriften von mind. 5% der registrierten Wähler einzureichen.
Anfangs von Präsident Correa selbst noch als ‚ein Haufen Faule‘, welche das sowieso nicht zustande bringen, verunglimpft, sammelte die ecuadorianische Zivilgesellschaft, angeführt vom neu gegründeten Kollektiv ‚YASUNIDOS‘ (‚Vereint für den Yasuní), 756’000 Unterschriften. Das ist eine komfortable Menge über dem nötigen Quorum von ca. 580’000 gültigen Unterschriften.
Was seither passiert ist, kommt einer Verhöhnung der in der Verfassung gewährten demokratischen Mitbestimmung gleich. Mehr als 700’000 Ecuadorianern sind in der Verletzung ihrer von der Verfassung zugestandenen Rechte betroffen:
- Die Aufsicht über die Überprüfung der gesammelten Unterschriften (Wahlbehörde CNE zusammen mit YASUNIDOS) ist einseitig und parteiisch. Es wurden – entgegen vorhergehender Abmachung und ohne Beisein von YASUNIDOS, versiegelte Unterschriftenschachteln geöffnet. Dazu ‚verschwanden‘ viele für die Verifizierung nötige ID-Kopien von Unterschriften-Sammlern. Wenn nur eine ID-Kopie verschwindet, werden unter Umständen Tausende Unterschriften ungültig.
- Eine grosse Anzahl Unterschriften wurden unter Anwendung von Militär- und Polizeigewalt und entgegen der vorgesehenen Prozedur aus dem Gebäude des CNE ‚abgeführt‘.
- YASUNIDOS wurden laut eigener Aussage vom CNE tagelang hingehalten, verspottet und schikaniert. Nach ein paar Tagen hatten sie die Nase voll von solch ungerechter Behandlung und zogen sich vom Prozess der ‚unabhängigen Überprüfung‘ unter Protest zurück.
- Eine grosse Anzahl Unterschriften wurde allein aus bürokratischen Gründen für ungültig erklärt (unerlaubte Dicke des Papiers, unerlaubtes Format des Papiers, unerlaubte Farbe des Papiers, Flecken auf den Unterschriftenbögen, unerlaubte Font-Schrift etc. etc.).
- Trotz all diesen Vorwürfen hat Präsident Rafael Correa sich während des ganzen Prozesses nicht dazu geäussert und auch keine Massnahmen ergriffen.
Aus diesen Gründen wendet sich YASUNIDOS an die internationale Gemeinschaft – also uns – um doch noch eine unabhängige Überprüfung der eingereichten Unterschriften zu erreichen, wenn möglich unter internationaler Aufsicht.
Es steht sehr viel auf dem Spiel:
- Das Weiterbestehen einer noch sehr jungen, hoffnungsvollen Demokratie in einem südamerikanischen Land, und somit das Verhindern eines Rückfalls in Zeiten von Chaos, räuberischen Präsidenten und Militärputschs (20. Jahrhundert)
- Der höchst biodiverse Amazonasnationalpark Yasuní, mit einer weltweit wohl unerreichten Populationsdichte vieler Tierarten, wie zum Beispiel des Jaguars. Das Yasunígebiet wird immer noch von mindestens zwei bisher ‚unentdeckten‘ und unkontaktierten Stämmen bewohnt (Tagaeri, Taromenane), welche sich bewusst gegen eine ‚Zivilisierung‘ wehren und seit Jahren immer mehr in ihrem Territorium eingekreist und eingeengt werden.
- Im Allgemeinen steht auf dem Spiel: Die Verteidigung aller noch bestehenden Urwälder und Tieflandregenwälder mithilfe demokratischer Mehrheiten. Wenn es in Ecuador nicht gelingt, die von der Verfassung gegebene Mitbestimmung der Bevölkerung in Fragen der Umweltzerstörung durchzusetzen: In welchem Land der Amazonasregion soll es sonst gelingen?! Empören wir uns als Erdenbürger in Solidarität mit der ecuadorianischen Gesellschaft und allen Bewohnern des Amazonas! Empören wir uns auch als Stimmen all derer, die überhaupt nicht gehört werden: Die Generationen der Zukunft und die autonomen Völker der Erde!
Die Zukunft der Amazonasregenwälder, Horte unvorstellbaren biologischen und kulturellen Reichtums, Stabilisatoren der weltweiten Klimavorgänge und unsere grössten Sauerstoff-Produzenten, steht endgültig auf der Kippe. Der Yasuní ist ein Symbol eines viel grösseren Bildes: Die Menschen dieser Erde sind überdrüssig, die Zerstörung des Lebens weiter mitanzusehen. Die Ecuadorianer sprechen für uns alle, wenn sie sagen „Jetzt ist genug! Bis hierher und nicht mehr weiter!“
Wir möchten das Drama des Yasuní – wohl der fantastischste Nationalpark auf der ganzen Welt – JETZT WELTWEIT BEKANNT MACHEN um zu zeigen, dass wir weiteren Raubbau an der Natur im Auftrag der Gier nach Erdöl, Mineralien und Megaplantagen nicht mehr tolerieren.
Bitte stehen Sie, die sich als Organisation oder Privatperson der Bewahrung der Menschenrechte / dem Schutz der Natur verschrieben haben, in Ecuador für diese Rechte ein. Werden Sie aktiv, sei es in der Bekanntmachung des Problems, in der Kontaktierung der ecuadorianischen Regierung und ihrer politischen Vertretungen weltweit, und vielleicht sogar in der Supervision des demokratischen Prozesses der Unterschriftenzählung und der Durchführung einer verfassungsmässigen Volksabstimmung zum Thema.
Ähnliche Projekte des Raubbaus gefährden momentan auch die Regenwälder Perus (zum Beispiel das riesige MANU Reservat). Die riesigen Ausmasse der Zerstörung in Brasilien und Indonesien sind hinreichend bekannt.
Die globale Gemeinschaft hat an diesem Fall Ecuador die einmalige Chance, ihre Geschlossenheit für die Erhaltung der wichtigsten Ökosysteme der Welt zu signalisieren. Wie die Ecuadorianer mit ihren Unterschriften können auch wir zeigen, dass eine Mehrheit der Bevölkerung GENUG hat und DAGEGEN ist. Es braucht kein Geld, es braucht einzig und alleine, dass wir alle unsere Stimmen erheben. Und wir werden keine Ruhe mehr geben und unsere Rechte der Meinungsäusserung nutzen bis eine globale Anwaltschaft zum Schutz der Regenwälder, ihrer Bewohner und ihrer natürlichen wie spirituellen Schätze erreicht ist. Es geht um nichts weniger als die Rettung unserer Würde und Rechtfertigung als moderne westliche Gesellschaft.
